Terms of Use
1. Your Responsibilities
It is your responsibility to provide complete and accurate information to Undo. Undo is using the information you provide to us to make suggestions pertaining to child support, spousal support and matrimonial property and debt division. Undo will not be responsible for any adverse consequences or damages of any kind if any of the information you provide is incorrect.
2. No legal advice
Undo is not a law firm and does not provide legal advice. Communicating with us or using any of the Services does not constitute legal advice or create a solicitor-client relationship. Any instructions, documentation, help content, blog posts, social media posts, support emails from our principals, employees, or contractors, social media replies from our principals, employees, or contractors, links to third-party websites, content contained in any such third-party websites linked to by us, and other similar content in and relating to the Service are provided for your convenience only. You agree that under no circumstance is any of the above to be construed as us providing legal advice to you.
If you select a package that includes lawyer-review of your documents, that review is for informational purposes only, to help you avoid making mistakes that will prevent your documents from being filed or granted. We will not provide any legal advice as to the relief you have sought in your divorce. Should you have legal questions pertaining to your divorce or your rights thereunder, you should consult a lawyer.
3. Changes to the Terms
From time to time, Undo may amend these Terms, and reserves the right to do so at any time. In the case of a change, we will post updated Terms and indicate the date of revision. If we feel the modifications are material, we will make reasonable efforts to bring the amendment to your attention. All new and/or revised Terms take effect immediately and apply to your use of the Services from that date on. Continued use of the website or Service after any such changes shall constitute your consent to such changes.4. Privacy and Security
Undo is committed to responsibly handling the information and data we collect through our Services in compliance with our Privacy Policy, which is incorporated by reference into these Terms of Use. Please review the Privacy Policy so you are aware of how we collect and use your personal information.
Undo will maintain commercially reasonable administrative, technical and physical procedures to protect your data and personal information. However, we cannot guarantee that unauthorized third parties will never be able to defeat those measures. You understand and agree that you use the Service at your own risk.
5. Payment
All payments are processed by Stripe, Inc. Collection and retention of credit card data is governed by their terms (stripe.com). Except as otherwise provided herein, all payments are non-refundable.
6. Limit on Liability
You understand and agree that the entire liability of Online Divorce Canada Inc. and our principals, employees or any other affiliated person, corporation or organization shall be at all times limited to the amount of CAD$500.00.
In no event will UNDO Divorce Inc., including our affiliates, and assigns, and each of our respective officers, directors, employees, agents, or shareholders, be liable to you for any incidental, special, exemplary, punitive, consequential, or indirect damages (including, but not limited to, damages for deletion, corruption, loss of data, loss of programs, failure to store any information or other content maintained or transmitted by Undo, service interruptions, or for the cost of procurement of substitute services) arising out of or in connection with the services, or this agreement, however arising including negligence, even if we know or have been advised of the possibility of such damages.
7. Guarantee
We cannot guarantee your divorce will be granted on the terms that you apply for, as that decision ultimately lies within the discretion of a judge. If you pay for one of our Services that guarantees your divorce will be granted but it is not granted, Undo will refund our fee (excluding any courthouse fees) and we will help you to make the necessary changes required to have it granted.
8. Copyright and Intellectual Property
The Service and all content reproduced on the clickUndo.ca website and in the provision of the Service is protected by copyright, trade secret, and other intellectual property laws, and we retain all rights, title and interest, including all intellectual property rights, in and to the Service. You acknowledge that the Service and all related documents are protected by Canadian copyright laws and international treaty provisions. You agree you will not reproduce, modify, copy, deconstruct, sell, trade or resell the Service.

Supplemental Terms or an Addendum will apply to anyone performing a service for Undo, including all Commissioners. Such terms will be disclosed to you once you have registered with us and shall be deemed to be a part of these Terms.
10. Governing Law
You agree to the exclusive jurisdiction of the Province of Alberta in governing any disputes that may arise under these Terms.
11. Waiver
Either party’s failure to insist on or enforce strict performance of any of the Terms will not be construed as a waiver of any provision or right.
12. Severability
If any part of the Terms is held to be invalid or unenforceable by any law or regulation or final determination of a competent court or tribunal, that provision will be deemed severed and will not affect the validity and enforceability of the remaining provisions.
